Terms of Service

These terms describe what tomapo actually does and what's expected of you as a user. By creating an account or uploading a document, you agree to them.

What tomapo is

tomapo gives you one place to store, understand, and stay on top of your insurance policies. You upload your policy documents (PDFs); tomapo keeps them in a single library, generates an AI plain-English summary of each one — what's covered, what's not, your deductible, and your renewal date, where the document states them — lets you ask follow-up questions about any policy, and tracks each policy's renewal date so you can see in-app what's expiring. It is a software and information tool only: it is not insurance, and it does not provide insurance, financial, or legal advice, act as an insurer, broker, or agent, or sell, arrange, underwrite, or handle insurance policies, claims, or payouts. It is not a substitute for your own policy documents or a conversation with your insurer or agent.

tomapo is operated by Francesca Anne Louise Angeles, trading as tomapo — an individual entrepreneur (autónomo) registered in Spain. Full identification of the operator is in our Legal Notice.

AI-generated content

Every summary and every chat answer is generated by AI directly from the document you uploaded, and is clearly labeled as AI-generated within the app. AI can make mistakes or miss context. Your original document is always available to download, and you should verify anything important — coverage limits, exclusions, dates — against it directly, or with your insurer, before relying on it.

Who can use tomapo

You must be at least 18 years old and have the legal capacity to enter into a contract to use tomapo. By creating an account, you confirm that you meet these requirements.

Your account

Accounts are created and authenticated through Clerk. You're responsible for keeping your account credentials secure and for the activity that happens under your account. Let us know at hello@tomapo.co if you believe your account has been accessed without your permission.

Uploading documents

You may only upload documents you have the right to upload — your own insurance policies, or ones you're authorized to act on. Before each upload, you'll be asked to confirm this and to consent to the document being processed as described in our Privacy Policy. You keep ownership of every document you upload; you grant us only the limited right to process it for the purpose of providing you the summary and chat features.

tomapo currently offers a free plan limited to one policy upload per account.

Subscriptions and billing

tomapo also offers a paid Premium plan. The free plan lets you keep one policy; Premium removes that limit, so you can add and manage as many policies as you like, with the same summaries, chat, and renewal tracking across your whole portfolio. Premium subscriptions are billed on a recurring basis (monthly or annually, as selected at signup) through our payment provider, Paddle.com Market Limited, who acts as the merchant of record for these transactions, and renew automatically until canceled. Acceptable use

You agree not to:

  • Upload a document you don't have the right to upload
  • Upload content that is unlawful, or use the service for any unlawful purpose
  • Attempt to access another user's account, data, or documents without authorization
  • Interfere with or disrupt the service, or attempt to circumvent its usage limits by automated or abusive means
  • Reverse engineer, scrape, or extract the underlying models, prompts, or source code of the service

Availability and changes to the service

We aim to keep tomapo available and working as described, but we don't guarantee uninterrupted access — the service depends on third-party providers (Clerk, Neon, Cloudflare, Microsoft Azure, and OpenAI) that are outside our control. We may change or discontinue features of the service; we'll update these terms if a change meaningfully affects what you're agreeing to here.

Ending your account

You can delete your account at any time from your account settings, which permanently deletes your data as described in our Privacy Policy. We may suspend or terminate an account that violates these terms, particularly the acceptable use section above.

Disclaimers and limitation of liability

tomapo is provided on an "as available" basis, without warranties of any kind beyond those that cannot be excluded under applicable law. Nothing in these terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under Spanish law. Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential losses, or for decisions made in reliance on an AI-generated summary without verifying it against your original policy document as recommended above. Nothing here limits the statutory rights you have as a consumer under Spanish or EU law.

Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, any dispute may be brought before the courts of your own domicile or ours, as Spanish consumer protection law provides; for users acting outside a consumer capacity, the courts of Barcelona, Spain will have jurisdiction.

Changes to these terms

If we update these terms, we'll revise the "Last updated" date above. If a change is material, we'll make reasonable efforts to let you know before it takes effect.
